0 Introduction
The Rules was prepared based on the safety risks and certification risks of toys, and it stipulates the basic principles and requirements for implementation of compulsory product certification for toys.
Toys shall not endanger the safety or health of any user or third party when used in a predetermined or predictable manner. When toys are only used by children of a specific age, the abilities of the user and his/her guardian under appropriate circumstances shall be taken into account.
In order to meet the above basic safety requirements, the applicant shall ensure that the toys entering the Chinese market can meet the certification standards, obtain the compulsory product certificate and be provided with CCC mark.
The Rules shall be used in conjunction with the general implementation rules issued by Certification and Accreditation Administration of the People's Republic of China (CNCA), such as Implementation Rules for Compulsory Product Certification - Classification, Management, Certification Modes Selection and Determination for Production Enterprises, Implementation Rules for Compulsory Product Certification - Utilization of Testing Resources and Other Certification Results of Production Enterprises, Implementation Rules for Compulsory Product Certification - General Requirements for Factory Inspection , etc.
Certification institutions shall, in accordance with the requirements of the general implementation rules and the Rules, prepare the implementation rules for certification, and shall implement both the general implementation rules and the Rules.
1 Application scope
The Rules is applicable to the electric toys, plastic toys, metal toys and vehicle toys designed or intended for children under 14 years old to play with.
The specific application scope and the adjustment of application scope due to changes in laws and regulations or related product standards, technologies, industrial policies and other factors, shall be subjected to the announcement issued by the State Administration for Market Regulation (CNCA).
2 Certification standards
GB6675.1 Toys safety- Part 1: Basic code;
GB6675.2 Safety of toys- Part 2: Mechanical and physical properties;
GB6675.3 Safety of toys- Part 3: Flammability;
GB6675.4 Safety of toys- -Part 4: Migration of certain elements;
GB19865 Electric toys-Safety (applicable to electric toys and electric vehicle toys. "Radiation, toxicity and similar hazards" in Clause 20 are exempt from testing, and shall be ensured by producers from the design to the selection of spare parts and raw materials, and it does not exempt producers from the responsibilities of Clause 20).
For the above standards, in principle, the latest versions issued by the national standardization administrative department shall be implemented. When other versions of the standards need to be used, they shall be implemented in accordance with the announcement issued by the CNCA on the requirements of relevant applicable standards.
3 Certification modes
The basic certification mode for implementing compulsory product certification for toys is as follows:
Type test + post-supervision certification
A small quantity of single batch of delivered/imported toys may be exempted from post-certification supervision, and the relevant requirements shall be specified by the certification institution in the implementation rules for certification, with the specific quantity determined through negotiation between the certification institution and the applicant.
The post-certification supervision above refers to the follow-up inspection after certification, sampling from the production site for testing or inspection, market sampling testing or inspection, or their combinations.
The certification institution shall implement the classified management on production enterprises according to the requirements of Implementation rules for compulsory product certification - Classification, management, certification modes selection and determination for production enterprises, and on the basis of basic certification mode, add relevant elements such as enterprise quality assurance capability and product consistency inspection according to the conditions in combination with the classified management results and combine various post-certification supervision methods, so as to determine the applicable certification mode for the applicant.
4 Certification unit division
In principle, certification units shall be divided by main material, structure, function, predetermined playing style, applicable age, etc. of toys. The certification institution shall specify specific requirements for the division of certification units in the implementation rules for certification.
The same products produced by the same producers in different production enterprises, or the same products produced by different producers of the same production enterprises may be divided into the same certification unit.
5 Application for certification
5.1 Submission and acceptance of certification application
The applicant shall submit the application for certification to the certification institution, which shall handle the application and feed back to the applicant whether it accepts or rejects the application within the time limit specified in the implementation rules for certification.
The certification institution shall not accept the application not complying with the requirements of the national laws & regulations and relevant industrial policies.
