TSG 08-2026 Special Equipment Service Administration Regulation English Translation Special Equipment Service Administration Regulation 特种设备使用管理规则 (English translation) Issued by the State Administration for Market Regulation of the People's Republic of China February 2, 2026 Special equipment service administration regulation 1 General 1.1 Purpose The Regulation is formulated based on Special Equipment Safety Law of the People's Republic of China, Law of the People's Republic of China on Conserving Energy, Regulations on Safety Supervision for Special equipment and Provisions on the Supervision and Administration of the Implementation of the Responsibility for Use Safety by Special Equipment User Entities to regulate the special equipment service administration and ensure the safe and economical operation of special equipment. 1.2 Scope of application The Regulation is applicable to the safety and energy conservation administration of special equipment within the scope of Special Equipment Catalogue. 1.3 Primary responsibility of users Special equipment users shall, in accordance with the provisions of the Regulation, fully perform their duties in the administration of special equipment safety and energy conservation, and shall bear the primary responsibility for the safety and energy conservation of special equipment service in accordance with the law. 1.4 Supervision and administration 1.4.1 Division of responsibilities Market supervision and administration departments at county level or above (hereinafter referred to as local market supervision departments) shall supervise and administer the service safety of special equipment and the energy conservation of high-energy-consuming special equipment within their respective administrative regions. The State Administration for Market Regulation supervises and guides the supervision and administration of the service safety of the special equipment and the energy conservation of high-energy-consuming special equipment throughout the country. 1.4.2 Service registration Local market administration departments or organizations having authority for special equipment service registration shall be responsible for handling special equipment service registration in accordance with their statutory duties and the requirements of the Regulation, except for special equipment that is explicitly exempted from service registration by the Regulation or other special equipment safety technical specifications (hereinafter referred to as safety technical specifications). 1.4.3 Supervision & inspection Local market supervision and administration departments shall be responsible for organizing supervision and inspection of the service safety of special equipment having been registered for service within their respective administrative regions, as well as the implementation of energy conservation for high-energy-consuming special equipment. In accordance with the principle of classified supervision, the aforesaid departments shall determine the key points of supervision and inspection based on risk conditions, formulate supervision and inspection plans, and perform on-site supervision and inspections; utilize information systems to perform off-site supervision and inspection on the periodic inspection status of special equipment that has been registered for use. 1.4.4 Informatization and safety status announcement Local market supervision and administration departments or organizations having the authority for special equipment service registration shall establish a special equipment management information system in accordance with the provisions on special equipment information administration, and shall input and update relevant data timely. The State Administration for Market Regulation and provincial-level market supervision and administration departments shall make public the overall safety status of special equipment annually. Market supervision and administration departments below the provincial level (excluding provincial-level) shall timely make public the safety status of special equipment within their respective administrative regions, if needed. 2 Users and their personnel 2.1 Meaning of users 2.1.1 General The users in the Regulation refer to the units with the right of service administration over special equipment (Note 2-1) or natural persons with full capacity for civil conduct, which are generally property right units of special equipment (the owners of property right, the same below), or the actual service administrator of special equipment established by the property right unit through the contractual relationship in accordance with the provisions of the law. If the special equipment is under common ownership, the co-owners may entrust the property service unit or other administrator to administrate the special equipment, then the trustee shall be the user; if the co-owners have not entrusted any entity, the actual administrator shall be the user; if there is no actual administrator, the co-owners shall be the users. If the special equipment is leased, the lessor shall be the user during the lease term; if otherwise specified in laws or stipulated by the parties in the contract, such provisions or stipulations shall prevail. Note 2-1: Units include companies, subsidiaries, government agencies and public institutions, social groups and other units with legal personality as well as such branches and individual businesses with business licenses. 2.1.2 Special provisions The users of gas cylinders generally refer to the filling units, while the users of vehicle gas cylinders, non-refillable gas cylinders and gas cylinders for respirator is the owner units. 2.2 Main obligations of users Main obligations of the users of special equipment are as follows: (1) establishing and effectively implementing the special equipment service safety administration system, high-energy-consuming special equipment energy conservation administration system and the operation procedures; (2) procuring and using special equipment that is manufactured (including design, manufacture, installation, modification, repair) under an approved license and that has passed inspection; it is prohibited to use special equipment that is explicitly phased out by the nation or has been scrapped; (3) establishing special equipment safety administration organizations, appointing appropriate safety administration and operating personnel, and ensuring they work with the required certifications; establishing personnel management records, conducting safety and energy conservation training, education, and assessments, and retaining records of training and assessments; (4) handling service registration and obtain the Special Equipment Service Registration Certificate (format as per Annex A, hereinafter referred to as the Service Registration Certificate); (5) establishing special equipment ledger and technical documentation; (6) inspecting the work of special equipment operators, timely stopping and correcting violations of operating procedures and relevant safety rules and regulations, and imposing criticism, education, or internal disciplinary action as appropriate; (7) establishing a mechanism for special equipment safety risk control and potential hazards identification; formulating the Special Equipment Safety Risk Control List based on the unit's actual circumstances; establishing and improving the working system of daily control, weekly inspection, and monthly scheduling with reference to corresponding safety administration standards (guidelines); (8) performing regular maintenance and periodic self-inspections (including elevator self-testing, same below) on in-use special equipment; timely identifying and eliminating potential hazards; periodically calibrating, inspect, and maintaining safety accessories, safety protection devices, and attached instruments and meters; timely applying for periodic inspection and energy efficiency testing, cooperating with such inspection and testing, and provide necessary assistance; (9) formulating special equipment accident-specific emergency response plan, and conducting emergency drills regularly; reporting accidents in time and cooperating in accident investigation and handling; (10) ensuring necessary investment in the safety and energy conservation of special equipment; (11) others obligations as prescribed by the laws and regulations. The users shall accept the supervision and inspection performed in accordance with laws by the market supervision departments. 2.3 Special equipment safety administration organization 2.3.1 Responsibilities A special equipment safety administration organization refers to the internal organization of users that undertakes the responsibility of special equipment safety administration. A user of high-energy-consuming special equipment may assign the energy administration responsibility to the special equipment safety administration organization. The responsibilities of special equipment safety administration organization are to implement relevant laws, regulations, safety technical specifications and associated standards for special equipment, and to be responsible for fulfilling the main obligations of the users; an organization assuming responsibility for the energy administration of high-energy-consuming special equipment shall also be responsible for conducting routine energy conservation inspections and implementing the energy conservation responsibility system. 2.3.2 Establishment of organization A user of special equipment meeting any of the following conditions shall establish a special equipment safety administration organization based on the category, type, purpose, quantity, etc., of its special equipment: (1) using utility boilers or complete sets of petrochemical and chemical process units; (2) using elevators that provide operational services to the public (Note 2-2), or using 30 or more (including 30) elevators in public gathering places (Note 2-3); (3) using 10 or more (including 10) large amusement facilities, or 10 or more (including 10) sightseeing vehicles for non-road use that provide operational services to the public; (4) using passenger aerial ropeways or passenger cable cars; (5) using 50 km or more (including 50 km) of pressure pipelines; (6) using a total of 50 or more (including 50) special equipment of various types (excluding gas cylinders) (Note 2-4). Note 2-2: A user of special equipment that provides operational services to the public refers to a user that uses special equipment as a means of profiting. Note 2-3: Public gathering places refer to schools, kindergartens, hospitals, stations, airports, passenger terminals, shopping malls, markets, dining establishments, sports venues, exhibition halls, parks, tourist attractions, amusement parks, hotels, cinemas, theaters, libraries, children's activity centers, public baths, nursing homes, etc. Note 2-4: Refers to special equipment that requires service registration (same as in 2.5.2.2). 2.4 Primary responsible person The primary responsible person refers to the actual highest-level administrator of the special equipment user, who bears overall responsibility for the safety and energy conservation of the special equipment used by the unit. Main responsibilities of the primary responsible person include: (1) establishing and implementing a long-term mechanism for fulfilling the primary responsibility for special equipment service safety; (2) implementing the establishment of the special equipment safety administration organization and the appointment of safety director and safety personnel; (3) supporting and ensuring that the safety director and safety personnel perform their duties in accordance with the law. 2.5 Safety administration personnel The safety administration personnel of a special equipment user include the safety director, safety personnel and energy administration personnel. 2.5.1 Safety director The special equipment safety director refers to a member of the user’s senior management who is in charge of the safety of the unit’s special equipment service. 2.5.1.1 Responsibilities of the safety director The main responsibilities of the safety director include: (1) organizing the dissemination and implementation of relevant laws, regulations, rules, safety technical specifications, and associated standards pertaining to special equipment; (2) organizing the formulation of the unit’s safety administration system for special equipment use (including filling, the same below), and implementing the responsibility system for special equipment service safety; (3) organizing to formulate special emergency plans for special equipment accidents and organizing regular drills; (4) implementing the obligations for reporting special equipment safety accidents and conducting rescue operations, and taking measures to prevent the accident from escalating; (5) providing safety education and technical training for safety personnel of special equipment and energy administration personnel of the user of high-energy-consuming special equipment, and supervising and guiding safety personnel and energy administration personnel in performing their relevant duties; (6) organizing the assessment of safety risks in special equipment service in accordance with regulations, and formulating and implementing risk prevention and control measures for special equipment service safety; (7) inspecting the service safety administration work of the unit’s special equipment, organizing the identification and investigation of special equipment safety hazards, timely reporting relevant situations to the primary responsible person, and proposing correction measures; (8) when a safety officer reports the existence of a serious (major) safety hazard that necessitates stopping the use of special equipment, the safety director shall organize analysis and assessment, take disposition measures, and report to the unit’s primary responsible person timely; (9) cooperating with departments concerned in conducting safety supervision and inspection, supervisory inspection, periodic inspection, and accident investigation of special equipment, and providing relevant materials truthfully.
