Guideline of examination for safety supervisors and safety staffs of special equipment users
1 General provisions
1.1 Purpose and basis
This Guideline is hereby formulated with a view to implementing the Regulations on supervision and administration of the implementation of main responsibility for safety of use of special equipment users and standardizing the examination work for the safety supervisors and safety staffs of special equipment users.
1.2 Application scope
This Guideline applies to the market supervision and administration departments’ supervised selective examination for the safety supervisors and safety staffs of special equipment users [including users of boilers, pressure vessels, pressure pipelines, elevators, lifting appliances, passenger ropeways, large-scale amusement facilities and special purpose motor vehicles in special fields, as well as gas cylinder filling units].
2 Examination requirements
2.1 Examination form
The examination form stipulated in this Guideline is an open-book theoretical examination, either written or computer-based. If conditions permit, it is recommended to carry out online examinations using the mobile terminals allocated for special equipment safety supervision personnel.
2.2 Examination content
The examination content is divided into nine aspects of knowledge content, including boilers, pressure vessels, gas cylinders, pressure pipelines, elevators, lifting appliance, passenger ropeways, large-scale amusement facilities, and special purpose motor vehicles in special fields, or their combinations. See Annexes A to J for details.
2.3 Implementation subject
(1) The market supervision and administration departments at or above the county level shall organize random supervised selective examination for the safety supervisors and safety staffs of special equipment users within their respective jurisdictions;
(2) During examinations for the special equipment safety supervisors and safety staffs by the market supervision and administration departments, participation of more than two special equipment safety supervision personnel is required, who shall show valid administrative law enforcement documents for safety of special equipment, and relevant professional and technical personnel may also be invited to participate as needed.
2.4 Examination arrangements
The examination is generally carried out in conjunction with routine supervision and inspection and special supervision and inspection.
2.5 Examination results
(1) According to the safety management ability requirements of the examination object's position, the special equipment safety supervision personnel shall randomly select a certain number of examination questions, and conduct on-the-spot examination for the special equipment safety supervisors and safety staffs. If more than 90% of the answers are correct, the examination is passed, otherwise it is failed;
(2) The special equipment users shall organize training for the safety supervisors and safety staffs who have failed the examination, and apply for a make-up examination for them within 5 working days to the market supervision and administration department that has implemented the examination. Those who fail the make-up examination shall not continue to hold the position.
3 Supplementary provisions
3.1 Interpretation authority
The State Administration for Market Regulation is in charge of the interpretation of this Guideline.
3.2 Implementation date
This Guideline shall come into force as of March 1, 2024.

A1.1 General requirements
A1.1.1 Laws and regulations
(1) The Special equipment safety law of the People's Republic of China and the Regulations on safety supervision of special equipment;
(2) The definition and classification of boilers in the Catalogue of special equipment;
(3) The Regulations on supervision and administration of the implementation of main responsibility for safety of use of special equipment users;
(4) The Supervision and management measures for special equipment operators;
(5) The Special equipment service administration regulation.

A1.1.2.1 Boiler production licensing requirements
(1) Requirements for the implementation of licensing system for boiler manufacturing, installation, repair and transformation units;
(2) Requirements for informing the process of boiler installation, transformation and repair;
(3) Requirements for supervision and inspection on the process of boiler manufacturing, installation, transformation and major repair.
