Management Measures for Restriction of the Use of Hazardous Substances in Electric Appliance and Electronic Product has passed the examination of ministry conference of Ministry of Industry and Information Technology and has been agreed by Development and Reform Commission, Ministry of Science and Technology, Ministry of Finance, Ministry of Environmental Protection, Ministry of Commerce, General Administration of Customs and General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China, and it is now published and implemented on July 1, 2016. Management Measures for Control of Pollution Caused by Electronic Information Products (Decree of former Ministry of Information Industry, Development and Reform Commission, Ministry of Commerce, General Administration of Customs, State Administration of Industry and Commerce, General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China and former Ministry of Environmental Protection, No. 39) published on February 28, 2006 shall be abolished simultaneously.

Chapter I General Provisions
Article I: The Measures are formulated according to those specified in such laws and administrative regulations as Law of the People’s Republic of China on Promotion of Cleaner Production, Law of the People's Republic of China on Prevention and Control of Environmental Pollution by Solid Waste and Administration Regulations for Recycle and Treatment of Waste Electrical Device and Electronic Products with a view to controlling and reducing environmental pollution caused by discarded electric appliance and electronic products, facilitating cleaner production and comprehensive resource utilization of electric appliance and electronic industry, encouraging green consumption and protecting environment and human health.
Article II: The Measures is applicable to electric appliance and electronic products production, sale and import within the territory of the People's Republic of China.
Article III: The meanings of the following terminologies in the Measures are as follows:
(I) Electric appliance and electronic products refer to equipment and auxiliary products with rated working voltage not exceeding 1,500 V (for direct current) or 1,000 V (for alternating current), which operate by way of current or electromagnetic field or with a view to generating, transmitting and measuring current and electromagnetic field; equipment involving in electrical energy generation, transmission and distribution are excluded.
(II) Pollution of electric appliance and electronic products refers to that hazardous substances in electric appliance and electronic products exceed the limit value of national or professional standard and cause such unfavorable influences as damage, harm, waste or others on environment, resource, human health as well as life, property and safety.
(III) Restriction of the use of hazardous substances in electric appliance and electronic products refers to the adoption of the following measures for reducing or eliminating pollution of electric appliance and electronic products:
1. Technical measures for restriction of the use of hazardous substances in electric appliance and electronic products by changing design scheme, adjusting process flow, replacing used materials and innovating manufacturing mode etc. in the process of design and production;
2. Measures of indicating names and their contents of hazardous substances as well as environment-friendly use period of electric appliance and electronic products in the process of design, production, sale and import.
3. Take strict requirements on goods procurement channel and reject to sell electric appliance and electronic products failing to meet national or professional standard for restriction of the use of hazardous substances in electric appliance and electronic products in sales process;
4. Prohibit importing electric appliance and electronic products failing to meet national or professional standard for restriction of the use of hazardous substances in electric appliance and electronic products in sales process;
5. Other measures for restriction of the use of hazardous substances in electric appliance and electronic products specified by the nation.
(IV) Management Catalog for Reaching the Standard with regard to Restriction of the Use of Hazardous Substances of Electric Appliance and Electronic Products (hereinafter referred to as Management Catalog for Reaching the Standard) is the catalog with a view to implementing use restriction management of hazardous substances in electric appliance and electronic products, including such contents as category of electric appliance and electronic products, type of hazardous substances restricted for use, restricted usage time and requirements for exception.
(V) Hazardous substances refer to the following substances contained in electric appliance and electronic products:
1. Lead and its compounds;
2. Mercury and its compounds;
3. Cadmium and its compounds;
4. Hexavalent chromium compounds;
5. Polybrominated biphenyls (PBB);
6. Polybrominated biphenyl ethers (PBDE);
7. Other hazardous substances specified by the nation.
(VI) Environment-friendly use period of electric appliance and electronic products refers to the period within which the hazardous substances contained in electric appliance and electronic products will not leak or mutate, severely pollute environment or cause serious injury to person and property when users use them normally according to product instruction.
Article IV: Ministry of Industry and Information Technology, Development and Reform Commission, Ministry of Science and Technology, Ministry of Finance, Ministry of Environmental Protection, Ministry of Commerce, General Administration of Customs and General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China, within their respective functions, manage and supervise the restriction of the use of hazardous substances in electric appliance and electronic products.
Article V: Ministry of Industry and Information Technology, jointly with relevant competent departments of the State Council, formulates measures facilitating restriction of the use of hazardous substances in electric appliance and electronic products and implements the relevant requirements on restriction of the use of hazardous substances in electric appliance and electronic products.
Article VI: Ministry of Industry and Information Technology, Development and Reform Commission, Ministry of Science and Technology, Ministry of Finance, Ministry of Environmental Protection, Ministry of Commerce, General Administration of Customs and General Administration of Quality Supervision, Inspection and Quarantine of the People's Republic of China in each province, autonomous region, and municipality directly under the Central Government, within their respective functions, supervise and manage the restriction of the use of hazardous substances in electric appliance and electronic products.
Ministries of Industry and Information Technology in province, autonomous region, and municipality directly under the Central Government are responsible for taking the lead in establishing provincial coordination mechanism for the work of restriction of the use of hazardous substances in electric appliance and electronic products and coordinating and solving major issues and problems in the work of restriction of the use of hazardous substances in electric appliance and electronic products within their own administrative areas.
Article VII: The nation encourages and supports scientific research, technology development and international cooperation relevant to restriction of the use of hazardous substances in electric appliance and electronic products and actively popularizes technologies and equipment replacing and reducing hazardous substances in electric appliance and electronic products.
Article VIII: Ministry of Industry and Information Technology and relevant competent departments of the State Council may praise or reward organizations and individuals actively developing and manufacturing electric appliance and electronic products for which the requirements are stricter than those in the Measures.
Competent departments of Ministry of Industry and Information Technology and other relevant competent departments in each province, autonomous region, and municipality directly under the Central Government may praise or reward organizations and individuals making remarkable achievement in the work of restriction of the use of hazardous substances in electric appliance and electronic products as well as relevant activities.
Chapter II Restriction of the Use of Hazardous Substances in Electric Appliance and Electronic Products
Article IX: During the design of electric appliance and electronic products, the designers shall not violate the obligatory standards specified by mandatory standard or by the laws, administrative regulations and rules; besides, under the premise of meeting the process requirements and according to the national or professional standards for the restriction of the use of hazardous substances in electric appliance and electronic products, they shall adopt such schemes which are harmless or less harmful, susceptible to degradation and convenient for recycling.
Article X: During the production of electric appliance and electronic products, the manufacturers shall not violate the obligatory standards specified by mandatory standards or by the laws, administrative regulations and rules; besides, according to the national or professional standards for restriction of the use of hazardous substances in electric appliance and electronic products, they shall adopt materials, technologies and processes which are of high resource utilization rate, prone to recycling processing and favorable to environmental protection, and they shall restrict or eliminate the use of hazardous substances in the products.
The producers of electric appliance and electronic products shall not produce or sell any products that are in unconformity with the requirements of the Measures.
Article XI: As for imported electric appliance and electronic products, they shall not be in violation of the obligatory standards specified by mandatory standard or by the laws, administrative regulations and rules and shall be in accordance with those national or professional standards for restriction of the use of hazardous substances in electric appliance and electronic products.
In accordance with the law, the entry-exit inspection and quarantine organizations shall carry out port verification and legal inspection for imported electric appliance and electronic products. The Customs shall check the Entry Customs Clearance Bill issued by entry-exit inspection and quarantine organizations and handle the formalities of Customs clearance according to the requirements.
